You have to fully agree with all the terms and conditions of this Agreement before You register as a User of the Websiteandhave access toits services. Your registration and operation on the Website will be deemed as Your voluntary acceptance to comply with all the terms and contents of this Agreement.
Article 1 Statement
1.1 The ownership of and the right to operate the online contents on the Website shall belong to International Health Qigong Federation (IHQF).
1.2 Before registering, users shall read this Agreement carefully and agree to abide by this Agreement. By clicking the "I Accept" button during registration, You are voluntarily accepting all the terms, conditions and contents of this Agreement. Upon successful registration, an agreement relationship between the User and the Website forms automatically, and the User shall be subject to complying with the terms and conditions ofthis Agreement. Before using special services or products/offerings, the User shall accept the relevant agreement(s) first.
1.3 Your use of the services of the Website is deemed that You have acknowledged and agreedtorelevant announcements of the Website.
1.4 This Agreement may be updated at any time by the Website, and the User shall promptly pay attention to and agree to these updates. The Websitehas no obligation to give notice on such updates additionally. The notices, announcements, statements or other similar contents of the Websiteconstitute an integral part of this Agreement.
1.5 The Website reserves the right to modify and/or suspend some or all of its services without prior notice to You, and does not assume any liability arising from You and/orany third parties.
1.6 The Website provides a free-of-charge registration service, and Your registration is a voluntary act. Upon successful registration, You can obtain more improved services from the Website.
1.7 If You lose Your accountID and password after You register as a User, the validity of Your handled services will not be affected. The Website can recover Your registered account ID and related information, but will not assume any other responsibilities/liabilities.
1.8 The specific contents of the Website are and will be provided based on actual situations.
Article 2Privacy of User
2.1 We promise to keep Your personal information and privacy confidential. Without Your authorization or consent, the Website will not disclose Your personal information to any third parties, except in the following circumstances, where the Websitewill not assumeany liability:
2.1.1 If a government agency requires the Website to provide Your personal information in accordance with the laws, administrative regulations, departmental rules, judicial interpretations and/or other normative legal documents of the People's Republic of China (collectively the "Laws and Regulations");
2.1.2 If we obtain prior explicit authorization of the User concerned;
2.1.3 In case of personal data disclosure resulting from the fact that Youtell or discloseYour UserIDand password to others;
2.1.4 In case of circumstances including but not limited to the disclosure, loss, theft or tampering of personal data/information caused by force majeure such as hacker attack, computer virus intrusion or attack, government control, etc.;
2.1.5 In case of disclosure of personal data resulting from that You have linked to other website(s) through the Website, and any legal disputes and consequences arising therefrom;
2.1.6 Because of measures taken to save others from being at risk that threats their lives, physicals or properties;
2.1.7 This Website may link with other websites, but is not responsible for the privacy policies and contents of other websites;
2.1.8 In addition, if You find any illegal use of Your user account or security vulnerabilities, You shall immediately notice the Website;
2.1.9 Your personal information disclosure caused by Your own negligence and/or other faults;
2.1.10 Your personal information may be disclosedin order to protect the social public interest;
2.1.11 Your records on the Website may become the evidence of Your violation of laws, regulations and/orthis Agreement.
2.2 The Website may cooperate with third parties to provide users with related network services, in which case, if suchthird parties agree to assume the same responsibility of protecting the privacy of users of the Website, the Website has the right to provide users’ registration information and other available information to such third parties.
2.3 On condition that the privacy of individual useris not disclosed, the Websiteshall be entitled to analyze the whole user database and utilize it for commercial purpose.
Article 3User Management
3.1 All Your acts on the Website must comply with the laws and regulations of the People’s Republic of China (“China”). You may not use the services provided bythe Website to make, copy, post and distribute the following information:
3.1.1 Information opposing the basic principles of the Constitution of the People's Republic of China;
3.1.2 Information endangering China’s national security, disclosing nation secret, subverting national power and destroying national unity;
3.1.3 Information undermining the honor and interests of the Chinese Nation;
3.1.4 Information inciting the ethnic hatred and ethnic discrimination and undermines the national unity;
3.1.5 Information damaging China’s national religious policy, promoting heresy and feudal superstition;
3.1.6 Information spreading rumors, disturbing social order and destroying social stability;
3.1.7 Information spreading obscenity, pornography, gambling, violence, murder, terrorism or abetting the crime;
3.1.8 Information insulting or slandering others, and/or infringing the legal rights and interest of others;
3.1.9 Other contents prohibited by laws and regulations.
3.2 Your acts on the Website must also comply with the laws and regulations of other countries and regions as well as the relevant provisions of international laws.
3.3 Users/You may not use the Website to conduct the following activities:
3.3.1 Entering the computer information network of others or using the resources of the computer information network of others without permission;
3.3.2 Deleting, modifying or increasing the functions of the computer information network of others without permission;
3.3.3 Deleting, modifying or adding the data and application program(s) stored, processed/operated or transmitted in others’ computer information network without permission;
3.3.4 Intentionally making and disseminating destructive programs such as computer viruses; and
3.3.5 Other acts damaging the safety of computer information network.
3.4 Users/You shall comply with other provisions and procedures of the Website:
3.4.1 You will assume the full liabilities for Your own acts/behaviors and operations onthe Website. Users/You promise that all information (i.e. works under the Copyright Law of the People's Republic of China, including but not limited to texts, pictures, music, movies, performances, audio-visual recordings, computer programs, etc.) posted thereby on or uploaded thereby to the Website enjoy the complete intellectual property rights, or have obtained the legal authorization from relevant right holders. If the Website is claimed by a third party due to the User's violation of this article, the User shall fully compensate for all costs/expenses incurred to the Website(including but not limited to various compensation fees/damages, litigation agency fees and other reasonable expenses incurred therefor).
3.4.2 Your liabilities shall be undertaken in the form of, including but not limited to, the compensation for the affected part and the Websiteequal compensation leading to administrative penalties or infringement caused by Your actions on the Website.
3.4.3 If the Website finds that the information You transmit contains one of the items listed in Article 3 of this Agreement, the Website reserves the right to, without notifying You, report to the relevant state authorities in China, keep the relevant records, delete the contents and link addresses, shut down the server, suspend the operation permissions of Your account, stop providing services to You, etc.
3.4.4 When a third party considers that the information published or uploaded by a User on the Website infringes upon his/her rights and sends a notice of right to the Website pursuant to the Regulations on the Protection of the Right to Communicate Works to the Public over Information Networks or the relevant laws and regulations, the User agrees that the Website may, at its sole discretion, decide to delete the alleged infringement information.Unless the User submits written evidence to exclude the possibility of infringement,the Website will not automatically recover such deleted information. The User shall also comply with the following rules:
(i) The User may not use the network service system for any illegal purpose;
(ii) The User shall comply with any and all of the network protocols, rules/regulations and procedures related to the network services;
(iii) The User may not use the Website to carry out any behavior that may haveany adverse impact on the normal operation of the Internet; and
(iv) The User may not use the Website for any purposes that are adverse to the Website.
3.4.5 If the User violates any of the above provisions while using network services, the Website reserves the right to require the User to correct or directly take all necessary measures (including but not limited to deleting the contents posted by the User, suspending or terminating the User's rights to use network services) to mitigate the impact of the User’s improper behavior.
Article 4Rights and Obligations of Registered Users
4.1 Registered Users have the right to use the service functions provided by the Website.
4.2 Registered Users agree to abide by the laws and regulations, including but not limited to, the Law of the People's Republic of China on Guarding State Secrets, the Regulations of the People's Republic of China for Safety Protection of Computer Information Systems, Regulations on Computers Software Protection, Administrative Provisions for Electronic Bulletin Services on the Internet, and Administrative Measures for Internet Information Services,etc.
4.3 You are obliged to provide complete and true personal information when registering as a User. Your personal information, if any changes, should be updated in time.
4.4 As a Registered User, You must take care of Your user name and password. All activities carried out after logging in are considered as Your own behaviors and wishes, for which You are fully responsible and liable.
4.5 When using the services on the Website, You agree to and accept the various information services provided by the Website.
4.6 The following acts/behaviors are prohibited when You use the Website:
4.6.1 Uploading, posting, emailing, or transmitting in any other forms any information or materials that violate Chinese national laws and regulations; suchinformation and materials include, but not limited to information, data/materials, text, software, music, photos, graphics, etc. (the same below);
4.6.2 Spreading information/materials with a nature of obscenity, pornography, gambling, violence, murder, terrorism or abetting crime;
4.6.3 Impersonating any person or entity, or misleading others in a false manner in relationship with any person or organization;
4.6.4 Interfering, damaging or limiting the functions of computer software, hardware or communications equipment of others through the Website;
4.6.5 Tracking or harassing others in other ways through the Website.
Article 5 Disclaimer
5.1 The User expressly agrees to solely undertake all risks and all consequences that may be generated due to the User’s use of the network servicesof the Website. The Website does not assume any liability therefor.
5.2 The Website cannot guarantee that the network services meet the requirements of any or all Users, and also does not guarantee the timeliness, security and accuracy of the network services.
5.3 The Website shall not guarantee the accuracy and completenessof the external links set up for the convenience ofthe Users. In addition, the Website shall not bear any liability for the contentson any webpage directed from such external links that are not actually controlled by theWebsite.
5.4 For the network service interruption or other defects arising from any force majeure or other reasons that the Website cannot control, the Website shall not bear any liability therefor, but willtry its best to reduce the resulting damage and impact on the Users.
5.5 The Website will not bear any liability for the quality defects of the following products/offerings and services provided tothe Users and any losses arising therefrom.
5.5.1The network services provided by the Websiteto the Users on a free-of-charge basis;
5.5.2 Any products/offerings or services provided by the Website as gifts to the Users.
5.6 The Website has the right to modify or terminate the services (or any part thereof) temporarily or permanently at any time, regardless of any notice. The Website will not bear any liability for the Users and any third party.
Article 6Intellectual Property Rights
6.1 All the domain names, trade names, trademarks, texts, videos and sound contents, graphics and images, unique logos, layout design and typesetting of the Website are owned or shared by the Website or authors, and are subject to the protection of relevant laws of ownership and intellectual property rights. Without prior written consent of the Website, the above may not be copied, reprintedand used by any individual or entity.
6.2 If the contents of the Website are maliciously reprinted, the Website reserves the right to resort to the law.
Article 7Supplementary Provisions
7.1 This Agreement is revised by the owner of the Website and announced on the Website. Your registration is regarded as You have voluntarily accepted the terms and conditions of this Agreement.
7.2 The effectiveness, implementation, interpretation and dispute settlement of this Agreement are governed by the laws of the People's Republic of China.
7.3 Any dispute arising from the use of the services provided by the Website, in principle, shall be settled through negotiation of both parties. If no agreement is reached through negotiation, any party shall have the right to bring in the proceedings of the people's court governing the Website owner.
7.4 If any of the terms and conditions of this Agreement conflict with any laws, the Website can re-interpret them, and other terms remain their legal effect and binding on Users.
7.5 International Health Qigong Federation (IHQF)reserves the right to interpret and amend this Agreement.
